Understanding Gender Discrimination
Gender discrimination occurs when an employee is treated unfavorably because of their sex, gender identity, or expression of their gender identity. This includes discrimination based on pregnancy.
Examples of Gender Discrimination
- Refusing to hire qualified candidates because of their gender
- Making offensive comments or jokes about a person's gender
- Paying men and women differently for the same work
- Creating a hostile work environment based on gender
- Denying promotions based on gender
- Terminating or demoting someone because of pregnancy
- Discriminating against transgender or non-binary employees
- Enforcing gender stereotypes in the workplace
Both California's Fair Employment and Housing Act (FEHA) and federal Title VII of the Civil Rights Act prohibit gender discrimination. These laws protect employees from discriminatory treatment in hiring, firing, promotions, compensation, and all other terms and conditions of employment.
